Terms of Service

1. Acceptance & Modification of Terms

By accessing, registering for, browsing, or utilizing the TIIER platform, websites, APIs, or related services (collectively, the "Service"), you explicitly agree to be legally bound by these Terms of Service. If you do not agree to every provision contained herein, you must immediately discontinue all use of the Service.

We expressly reserve the unilateral right to update, modify, add, or remove portions of these Terms, including valuation guidelines, fee structures, and drop operational rules, at any time at our sole discretion without prior notice. Your continued use of the Service following any published revisions constitutes full and irrevocable acceptance of the modified Terms.

2. Service Description & Digital Twin Registry

TIIER operates as an independent digital twin registry, authentication verification interface, and digital vaulting catalog for physical collectible trading cards and memorabilia. Our platform catalogs asset provenance, tracks digital ownership status, and provides synchronized guide valuations.

TIIER does not operate as a financial institution, escrow agency, securities exchange, or appraisal authority. Digital twins represent cryptographic records of physical collectible provenance and do not constitute legal tender, currency, or financial investment contracts.

3. Digital Twin Ownership & Verification

A "Digital Twin" is a unique non-fungible ledger record corresponding to an individual physical collectible item within our ecosystem. Legitimate binding of a digital twin to a user account requires physical possession and entry of the authentic, one-time-use alphanumeric security claim code.

A claimed digital twin serves as a certificate of cataloged authenticity and registration on the TIIER platform. Ownership of a digital twin on the platform reflects registry status and does not supersede physical custody, third-party grading certification, or manufacturer copyright.

4. Code Security, Claiming & Irreversibility

Users maintain sole and exclusive responsibility for safeguarding the confidentiality and physical integrity of all claim codes, security QR payloads, and account credentials. Once a claim code is validated and bound to a digital vault, it is permanently and irreversibly deactivated across the registry.

TIIER shall bear no liability for compromised, lost, stolen, or improperly transferred claim codes resulting from user negligence, third-party interception, or secondary market resale. TIIER is under no legal obligation to reassign, reissue, or reverse any completed claim.

5. Third-Party Marketplaces, Live Streams & Fulfillment

TIIER partners with independent content creators, streamers, and storefronts to provide digital twin verification for promotional mystery pack drops. TIIER does not execute the live streaming, pack opening, retail billing, physical packaging, or postal shipping of physical cards.

All physical delivery timelines, condition inquiries, shipping insurance, and purchase transactions remain strictly between the customer and the respective independent streamer or third-party marketplace (e.g., Whatnot, TikTok Shop, Shopify). Any order disputes or fulfillment claims must be pursued directly with the seller of record.

THE SERVICE IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, TIIER, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, ASSET DEPRECIATION, OR SYSTEM INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE.

8. Account Suspension, Termination & Forfeiture

TIIER reserves the absolute right to suspend, freeze, restrict, or terminate any user account, vault access, or associated digital twin registrations without liability if a user is determined to have violated these Terms, engaged in fraudulent claim attempts, exploited technical glitches, manipulated pricing feeds, or engaged in unlawful conduct.

9. Governing Law & Jurisdiction

These Terms of Service and any disputes or claims arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any choice of law or conflict of law provisions.
